These General Promotions Terms & Conditions ("General Rules") apply to all promotions, giveaways, contests, referral programs, bonus offers, and other incentives (each a "Promotion") offered by SmackTok ("SmackTok," "we," "us," or "our"). By participating in any Promotion, you agree to be bound by these General Rules, the specific terms for that Promotion (as posted on the applicable promotion page), our Terms of Service, and our Privacy Policy. In the event of any conflict, the specific Promotion terms control over these General Rules.

1. Eligibility

• Promotions are open only to individuals who are at least 18 years of age (or the age of majority in their jurisdiction, whichever is higher) and legal residents of a U.S. state or jurisdiction where SmackTok is licensed, operational, and such Promotion is permitted by law ("Eligible Jurisdictions").

• You must have a valid, active SmackTok account in good standing to participate.

• Employees, officers, directors, agents, and immediate family members (spouse, parents, siblings, children, and each of their respective spouses) or household members of SmackTok, its affiliates, subsidiaries, advertising/promotion agencies, prize providers, or any entities involved in the administration of a Promotion are not eligible.

• Void where prohibited or restricted by law. Participation is subject to all applicable federal, state, and local laws and regulations.

2. Promotion-Specific Details Each Promotion will have its own page (e.g., /promotions/[promotion-name]) detailing:

• Promotion period (start and end dates/times, in PDT unless otherwise stated).

• How to enter or participate (e.g., referrals via unique link, opt-in requirements).

• Prize(s) or rewards (including approximate retail value where applicable).

• Winner selection method (e.g., most referrals, random draw).

• Any tie-breaking procedures.

• Additional entry restrictions or verification steps.

All times are in Pacific Daylight Time (PDT) unless otherwise specified.

3. Bonus Funds & Rewards

• All monetary prizes, referral bonuses, credits, or other cash-equivalent rewards are issued exclusively as bonus funds in your SmackTok account.

• Bonus funds expire 90 days after being credited (unless a different expiration is specified for a particular Promotion).

• Bonus funds must be played through (wagered) at least one (1) time on eligible contests or plays in the SmackTok app before any associated winnings or remaining balance can be withdrawn as cash.

• Standard SmackTok withdrawal, playthrough, and account rules apply. Bonus funds have no cash value outside the app, are non-transferable, and cannot be combined in certain ways unless specified.

• Physical prizes (e.g., collectible cards) will be shipped to the verified address of the winner within a reasonable timeframe (typically 4–8 weeks) after verification. Winners are responsible for any shipping costs, taxes, or duties.

4. Winner Selection & Notification

• All decisions by SmackTok regarding eligibility, participation, winner selection, prize verification, and Promotion administration are final and binding in all respects. No correspondence will be entered into.

• Winners may be notified via in-app message, email, or other contact method associated with their account.

• Winners must respond within the timeframe specified (or 7 days if not stated) and complete any required verification (e.g., identity, age, location, tax info). Failure to do so may result in disqualification and selection of an alternate winner.

• In case of a tie, SmackTok may use tie-breakers such as earliest qualifying entry timestamp or another fair method at our discretion.

5. Prize Fulfillment & Taxes

• Prizes are awarded "as is" with no warranties. SmackTok makes no representations regarding prize quality, condition, or authenticity beyond what is stated.

• Winners are solely responsible for all applicable federal, state, and local taxes, fees, or other obligations related to prizes.

• If total winnings meet IRS reporting thresholds, winners may receive a Form 1099-MISC or equivalent. By participating, you agree to provide any necessary tax information upon request.

6. General Conditions

• SmackTok reserves the right to disqualify any participant, entry, or referral suspected of fraud, tampering, abuse, or violation of these General Rules or Promotion-specific terms (including use of multiple accounts, bots, or fake referrals).

• SmackTok is not responsible for lost, delayed, incomplete, or misdirected entries/referrals; technical failures; or issues with internet, app, or device connectivity.

• Participation constitutes permission (except where prohibited by law) for SmackTok to use your name, likeness, voice, and/or biographical information for promotional purposes without further compensation.

• By participating, you release SmackTok, its affiliates, partners, and prize providers from any liability related to the Promotion or prizes.

• Promotions are not sponsored, endorsed, or administered by, or associated with, the NCAA, any sports league, social media platform, or third party unless explicitly stated.

7. Modification & Termination SmackTok reserves the right to modify, suspend, cancel, or terminate any Promotion (or these General Rules) at any time for any reason, including but not limited to technical issues, fraud, or legal requirements, without liability.

8. Governing Law & Disputes These General Rules are governed by the laws of the State of California, without regard to conflict of laws principles. Any disputes arising from a Promotion shall be resolved in accordance with our Terms of Service.
