Welcome to SmackTok Holdings, LLC (“SmackTok,” “we,” “us,” or “our”). These Game Rules govern participation in our skill-based fantasy sports contests offered through SmackTok.com (“Site”) and our mobile application on iOS and Android (“App”) (collectively, the “Services”). By participating, you agree to these Game Rules, our Terms of Service, and Privacy Policy, available at https://www.smacktok.com/terms-of-service and https://www.smacktok.com/privacy-policy. These rules ensure fair, transparent, and compliant gameplay.

1. Overview of SmackTok Contests

SmackTok offers skill-based fantasy sports contests where you draft a roster of 2 to 6 athletes from real-world sporting events across sports like football, basketball, baseball, hockey, soccer, golf, and mixed martial arts. You predict whether each athlete will exceed or not exceed a specific statistical threshold (e.g., points, yards, goals) in their respective game. Winning depends on your knowledge, skill, and ability to analyze athlete performance, not on the outcome of a single game or an individual athlete’s performance. Contests are available as free-to-play or paid entries, with identical rules for both.

2. Eligibility

To participate, you must:

  • Be at least 18 years old (or the age of majority in your jurisdiction if higher).

  • Reside in an eligible jurisdiction: California, District of Columbia, Georgia, Illinois, Indiana, Minnesota, Nebraska, New Mexico, North Carolina, North Dakota, Oklahoma, Rhode Island, South Carolina, South Dakota, Texas, Utah, Vermont, or Wisconsin.

  • Create a single account with accurate information, verified via Paydala’s Know Your Customer (KYC) process, including real name, date of birth, driver’s license, and partial social security number.

  • Not be a professional or amateur athlete, sports agent, referee, or anyone able to influence real-world sporting events used in our contests.

We use Paydala’s geolocation technology to confirm your location and restrict access from prohibited jurisdictions. Non-compliance may result in account suspension or termination.

3. How to Play

3.1 Open Draft System

SmackTok uses an open draft system, allowing all participants equal opportunity to select any available athlete without random draft orders or salary caps. You draft 2 to 6 athletes from at least two different real-world teams, enhancing the skill-based nature of the contests. You cannot select the same athlete for multiple statistical predictions in a single entry (e.g., Josh Allen for both rushing and passing yards).

3.2 Making Predictions

For each athlete, you predict whether they will perform over or under a statistical projection (e.g., “Will LeBron James score over 25.5 points?”). Projections are generated by SmackTok based on historical data and analytics. Your roster’s success depends on the accuracy of your predictions, evaluated against official statistical results from real-world events.

3.3 Contest Formats

Contests are offered in five formats based on roster size:

  • 2-player contests

  • 3-player contests

  • 4-player contests

  • 5-player contests

  • 6-player contests

Each format (except 2-player, which is Prime-only) offers two payout options:

  • Flex: Pays out for a minimum number of correct predictions, with partial payouts for fewer correct picks.

  • Prime: Requires all predictions to be correct for a payout.

4. Payout Structures

Prizes are fixed, disclosed before entry, and independent of participant numbers, ensuring compliance with the Unlawful Internet Gambling Enforcement Act (UIGEA). Payouts vary by contest size and format. Below are typical multipliers of the entry fee:

In Prime, all predictions must be correct; any incorrect prediction results in forfeiture of the entry fee.

4.3 Prize Distribution

Prizes are distributed as soon as reasonably practicable after contest conclusion, typically as fixed cash sums, via Paydala. The number of winners is not fixed; all participants with sufficient correct predictions win based on the payout structure. Exact payouts are displayed before entry.

5. Entry Fees

Paid contests have minimum and maximum entry fees, compliant with state regulations where applicable. Fees and potential payouts are clearly displayed before you confirm entry. You must confirm the fee to participate. Free contests are also available, with identical rules.

6. Scoring and Results

Winning outcomes are determined by objective statistical results from real-world sporting events, as reported by official sources. Results reflect the accumulated performance of your roster across multiple events, not a single team’s score, point spread, or an individual’s single-game performance, ensuring compliance with UIGEA. Live scoring updates are available on the App, but final results are confirmed post-event. In case of discrepancies, official statistics prevail.

7. Contest Cancellation and Refunds

SmackTok reserves the right to cancel a contest entry and issue a full refund of the entry fee if we detect a glitched or erroneous statistical line (e.g., incorrect projection or data error) before the relevant real-world sporting event begins. Such cancellations are at our sole discretion to maintain fairness and integrity. Refunds will be processed promptly to your account via Paydala. We may also cancel, modify, or suspend contests due to:

  • Technical errors or system failures.

  • Suspected fraud or collusion.

  • Event cancellations or postponements beyond our control.

In such cases, affected entries will be refunded, and no further liability will be incurred.

8. Fair Play and Conduct

Contests are skill-based, relying on your knowledge and analysis. You agree not to:

  • Engage in fraudulent activities, such as collusion or using automated tools (e.g., bots).

  • Manipulate contest outcomes or exploit system errors.

  • Use insider information or influence real-world events.

Violations may result in forfeiture of winnings, account suspension, or legal action. SmackTok monitors contests for fairness and compliance.

9. Compliance with Laws

SmackTok contests are designed to comply with federal laws (e.g., UIGEA) and state laws in eligible jurisdictions, where skill predominates over chance under the “predominant factor” test. Contests meet UIGEA requirements by:

  • Not basing rosters on a single team’s membership.

  • Fixing and disclosing prizes in advance, independent of participant numbers.

  • Determining outcomes by accumulated statistical results of multiple athletes across multiple events.

  • Excluding outcomes based on single-team scores or single-athlete single-game performances.

In Indiana and Vermont, SmackTok complies with state fantasy sports regulations, including licensing or registration. You are responsible for ensuring your participation complies with local laws.

10. Modifications to Game Rules

We may update these Game Rules by posting the revised version on the Site or App with a new “Effective Date.” Material changes will be communicated via email or push notification. Continued participation constitutes acceptance of the updated rules.
