SmackTok Bonus Engine Terms & Conditions
Introduction and Incorporation
These Bonus Engine Terms and Conditions (“Bonus Terms”) govern participation in the promotional and bonus features offered on the SmackTok daily fantasy sports platform (the “Platform,” “SmackTok,” “we,” “us,” or “our”), including: Play Token, Profit Boost, Deposit Match, Smacks Multiplier, Insurance, and Free Leg (each, a “Bonus Engine,” and collectively, the “Bonus Engines”).
These Bonus Terms supplement, and are incorporated into, SmackTok's Terms of Use and Privacy Policy (together, the “Master Terms”). By opting into, activating, or otherwise using any Bonus Engine, you agree to these Bonus Terms in addition to the Master Terms. If these Bonus Terms conflict with the Master Terms, these Bonus Terms control solely as to the specific Bonus Engine at issue.
SmackTok reserves the right to amend, suspend, or discontinue any Bonus Engine, in whole or in part, at any time, with or without notice, subject to applicable law and regulatory approval.
General Eligibility & Compliance (Applies to All Bonus Engines)
Age & Identity
You must be at least 18 years of age to participate in any Bonus Engine, except in Nebraska, where you must be at least 19. If SmackTok later enters a state with a higher minimum age (for example, 21+ in Arizona, Iowa, Massachusetts, or Virginia), the higher minimum applies there. See the state-by-state matrix in Section 10.
You must complete SmackTok's identity and age verification (KYC) process before any Bonus Engine credit, refund, or reward becomes withdrawable.
One SmackTok account, one identity, and one household per Bonus Engine offer, unless the specific offer states otherwise. Duplicate, multiple, or shared accounts will be flagged, and associated bonus funds, tokens, boosts, refunds, or Smacks forfeited.
Geographic Eligibility (Eligible States)
You must be physically located, at the time of entry, within a state where SmackTok's paid contests are then offered (an “Eligible State”). SmackTok currently offers its paid contests and these Bonus Engines in: California, District of Columbia, Georgia, Illinois, Indiana, Minnesota, Nebraska, New Mexico, North Carolina, North Dakota, Oklahoma, Oregon, Rhode Island, South Carolina, South Dakota, Texas, Utah, and Wisconsin (collectively, the “Eligible States”).
Bonus Engines are void where prohibited by law and are not available to users physically located outside the Eligible States, or in any state SmackTok later designates as restricted. Any state not listed above is an Excluded State for purposes of these Bonus Terms.
Certain Eligible States impose licensing/registration obligations on SmackTok (e.g., Illinois and Indiana) or present heightened legal risk for multi-leg / “pick’em”-style contests (e.g., Utah, Oregon, Texas, and California). Availability of any Bonus Engine — and in particular the multi-leg engines (Insurance and Free Leg) — is subject to the state-specific terms and flags in Section 10, and SmackTok may withhold or restrict any engine in any state to comply with applicable law.
Self-Exclusion & Responsible Play
Any user enrolled in a state or SmackTok self-exclusion, cooling-off, or exclusion program, or otherwise restricted from play (including by employment-based restriction), is ineligible to participate in any Bonus Engine and immediately forfeits any related bonus funds, tokens, boosts, refunds, or Smacks.
SmackTok will not target self-excluded users with Bonus Engine marketing, offers, or notifications.
Nature of Contests
SmackTok's paid contests are fantasy sports contests in which outcomes are determined predominantly by the knowledge, skill, and judgment of participants, and are offered for entertainment purposes. Nothing in these Bonus Terms, and no Bonus Engine, changes that character or guarantees any result. If you or someone you know shows signs of a gambling problem, help is available — see Section 11 (Responsible Gaming Resources).
General Bonus Terms (All Bonus Engines)
Sole Discretion. SmackTok may modify, restrict, suspend, or cancel any Bonus Engine or specific offer at any time, and may refuse, limit, or revoke eligibility for any user, for any reason, including suspected abuse, contest-pattern review, or a customer's failure to use a prior promotion in good faith.
No Cash Value Unless Stated. Tokens, boosts, bonus credits, refunds issued as bonus credit, and Smacks have no cash value, are not currency, are non-transferable, and are not withdrawable except to the extent expressly stated in the applicable Bonus Engine section, and only after satisfying any applicable playthrough/turnover requirement.
Anti-Abuse. Circumventing eligibility checks, using multiple or shared accounts, colluding, or engaging in patterns designed to extract value from a Bonus Engine without genuine contest participation is prohibited and will result in forfeiture, and may result in account suspension.
One Offer Per Customer. Unless the specific offer states otherwise, each Bonus Engine offer may be claimed once per person, household, and payment method/device, regardless of the number of accounts involved.
Order of Funds. Where an account holds both bonus/promotional funds and deposited (cash) funds, bonus/promotional funds are applied to entry fees before cash funds, unless the Platform allows the user to select a funding source at entry.
Taxes. You are solely responsible for any federal, state, and local tax obligations arising from any Bonus Engine credit, refund, reward, or associated winnings. SmackTok may report amounts as required by law (e.g., Form W-2G or the 1099 series, as applicable).
Errors. SmackTok is not liable for technical, computer, or platform malfunctions, or for erroneous issuance of any bonus, and reserves the right to correct any such error, including by reversing an erroneously issued credit.
Regulatory Approval. All Bonus Engine offers are subject to regulatory approval in each applicable jurisdiction and may be withdrawn or adjusted to comply with state gaming or consumer-protection requirements.
Dispute Resolution; California Notice; Statute of Limitations
Disputes arising from a Bonus Engine are resolved under the binding arbitration and class-action-waiver provisions of the Master Terms.
California Civil Code § 1789.3: California users may contact the Complaint Assistance Unit, Division of Consumer Services, California Department of Consumer Affairs, 1625 N. Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
Claims relating to a Bonus Engine must be filed within one (1) year of the event giving rise to the claim, except where prohibited by law (e.g., New Jersey).
Severability & Waiver
If any provision of these Bonus Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision will be interpreted to reflect the parties' original intent as closely as permitted by law. SmackTok's failure to enforce any provision is not a waiver of that provision.
